1

Scope

These General Terms and Conditions (GTC) apply to all sales, consultations, and services provided by Graf Classics, regardless of whether they are conducted in person, by phone, by email, via WhatsApp, or through any other means. Deviating terms and conditions of the customer are only recognized if they have been expressly confirmed in writing by Graf Classics.

2

Offer and conclusion of contract

All offers made by Graf Classics are non-binding and without obligation. A contract is only concluded once Graf Classics has confirmed the order or sale verbally or in writing, or upon delivery of the goods. All prices are stated in Swiss francs (CHF).

3

Sales types

Graf Classics sells:
a) Watches from its own inventory (“Direct Sale”)
b) Watches on behalf of clients (“Commission Sale”)

Both types of sales are subject to the following provisions, unless expressly agreed otherwise.

4

Prices and payment terms

The purchase price must be paid in the agreed amount.
Accepted payment methods are:
• Cash payment upon delivery
• Card payment upon delivery (all major debit cards, no credit cards)
• Bank transfer (prepayment; payment must be received before delivery)

Shipping or handover will only take place after full payment has been received.

5

Prices and payment terms

Shipping by Graf Classics is carried out exclusively as insured value transport. Graf Classics is liable for the shipment until proven delivery to the buyer, provided there is no fault on the part of the shipping service provider. In the event of a verified shipping loss, Graf Classics will seek compensation through transport insurance. Personal delivery is considered complete upon handover to the buyer.

6

Retention of title

The goods remain the property of Graf Classics until full payment has been received. If payment is not made in full, Graf Classics reserves the right to reclaim the goods.

7

Warranty and guarantee

Graf Classics guarantees the authenticity of every watch sold.

For mechanical watches, Graf Classics provides a mechanical warranty of twelve (12) months from the date of purchase.
This warranty covers only mechanical defects that are not caused by improper handling or external interference.

The following wear parts are excluded from the warranty:
• Gaskets
• Strap (metal, leather, textile, etc.)
• Crown
• Crystal

Any intervention by third parties (e.g., watchmakers or service providers outside of Graf Classics) will immediately void both the warranty and the authenticity guarantee.

8

Return and revocation

As a rule, there is no right of return or withdrawal. Each sale is binding once the contract has been concluded.

9

Commission sales

In commission sales, Graf Classics sells a watch entrusted by the customer in its own name but on the customer’s account.

Storage:
During the consignment period, the watch, box, and accompanying documents are stored in a bank safe by Graf Classics.

Price Agreement and Commission:
Before accepting the watch, a minimum or target price is agreed upon with the customer. The commission structure is determined individually and documented in writing.

Risk Allocation:
The risk of loss, theft, or damage during storage or the sales process lies with the customer, unless expressly agreed otherwise.

Completion of Sale:
A commission sale is considered complete once the buyer has paid the agreed purchase price in full.

10

Product descriptions and images

All descriptions, photos, and representations of watches on the website, in offers, or in other media are provided for general information purposes. Minor differences in color or texture between the images and the actual product may occur and do not constitute a defect. The condition of the watch at the time of the sale is decisive.

11

Liability

Graf Classics is liable only for damages caused by intentional or grossly negligent conduct. No liability is assumed for indirect damages, loss of profit, or consequential damages. Graf Classics accepts no liability for any damage resulting from repairs or interventions by third parties.

12

Data protection

Graf Classics collects and processes personal data exclusively in accordance with legal requirements. Further information can be found in the privacy policy on the Graf Classics website.

13

Right of withdrawal / cancellation by Graf Classics

Graf Classics reserves the right to withdraw from the contract or cancel an order if legitimate reasons exist.
Such reasons may include, in particular, payment defaults, missing payment confirmations in the case of prepayment, doubts about the buyer’s creditworthiness, or unforeseen delivery obstacles.
In the event of a cancellation, any payments already made will be refunded immediately.
Further claims by the buyer are excluded.

14

Applicable law and place of jurisdiction

Swiss law applies exclusively. The place of jurisdiction is Kreuzlingen (Canton of Thurgau).

15
